1. General - Scope of Application
These ATGB apply to the legal relationship established by the purchase and/or use of day tickets, general tickets and/or other, e.g. VIP, admission tickets (collectively "Admission Tickets") from the municipality of Ruhpolding or from sales outlets authorized by the Municipality of Ruhpolding, in particular for attendance at events (co-)organized by the Municipality of Ruhpolding ("Events"), as well as admission to and stay in the Chiemgau Arena. The Chiemgau Arena is a proprietary enterprise of the municipality of Ruhpolding without own legal personality.
2. Offer, conclusion of the contract, content of the contract, presentation of the ticket at the entrance
2.1 Purchase channels: Admission tickets are to be purchased (by phone, by email or online) exclusively through the sales channels authorized by the municipality of Ruhpolding. These are:
b) The official website of the OC Ruhpolding: www.biathlon-ruhpolding.de, with the link to the organizer’s store https://biathlon-ruhpolding.reservix.de. The purchase of the tickets takes place via the exclusive ticket partner of the municipality of Ruhpolding, the Reservix GmbH (with the brands Reservix and ADticket; together "Reservix").
c) The official websites of Reservix: www.reservix.de as well as www.adticket.de.
d) The authorized Reservix advance booking offices and ticket stores, which are listed on the website www.reservix.de/vorverkaufsstellen and at www.adticket.de/Liste-der-Vorverkaufsstellen.html.
e) Box office at the event site of the Chiemgau Arena.
If tickets are purchased through sales outlets authorized by the municipality of Ruhpolding, in particular the ticket partner Reservix, additional GTC may apply. Should these GTC contain regulations that contradict these GTC of third parties, these GTC take precedence in the relationship between the customer and the municipality of Ruhpolding, provided that they have been duly included in the purchase process or at the latest upon entry to the Chiemgau Arena.
The customer acknowledges that the municipality of Ruhpolding is entitled for good cause, e.g. due to specified protective measures in the context of pandemic control, to restrict the purchase channels for admission tickets to online sales.
2.2 Order: In the case of an online order, the purchase options presented on one of the above-mentioned purchase paths do not contain a contractual offer on the part of the municipality of Ruhpolding, but only an invitation to submit an offer by the customer. With the online order provided for this purpose, the customer submits a binding offer to the municipality of Ruhpolding to purchase the selected tickets. The contract is concluded when the order is confirmed or the desired tickets are made available electronically in the so-called "[email protected]" procedure for printing, sent by mail or handed over at the point of sale. In the case of an order placed on site or by telephone, the contract is concluded when the tickets are handed over or sent.
2.3 Right of access: The municipality of Ruhpolding does not wish to grant access to events to everyone, but only to those ticket holders who have purchased tickets as a customer from the municipality of Ruhpolding or an authorized sales outlet or within the scope of a permissible transfer according to section 5.2. The municipality of Ruhpolding therefore only grants a right of access ("right of access") to its customers who are identifiable by individualization features printed on the admission ticket (e.g. bar code/QR code and/or booking number, etc.) and/or to secondary purchasers who have permissibly acquired admission tickets in accordance with section 5.2. The right of access ends when the ticket holder leaves the Chiemgau Arena event site for the first time. In the event of an admission ticket acquisition in the context of an inadmissible transfer according to section 5.1, there is no right of access. In this case, the municipality of Ruhpolding reserves the right to refuse access. Claims for recourse against the municipality of Ruhpolding are excluded in this case. To prove his identity, the customer has to carry an official document (e.g. identity card) and show it on demand. The municipality of Ruhpolding fulfills its obligations regarding the right of access of the customer or the respective ticket holder by granting one-time access to the event. The municipality of Ruhpolding will also be released from its obligation to perform if the ticket holder has not acquired an effective right of access in accordance with this clause. The customer has no claim that a specific competition will be held on that day, even if a specific competition is indicated on the admission ticket.
2.4 Special access conditions / pandemic control: If, for an important reason, e.g. due to specified protective measures in the context of pandemic control or in the context of a partial exclusion of spectators due to official instructions in accordance with section 6.3, certain proof is required for access to the event site, the municipality of Ruhpolding is obligated to have this proof presented to it by the customer in the sense of an access requirement at the latest immediately before access to the event site. If the customer is unable to meet the relevant requirements, the municipality of Ruhpolding may refuse access to the Chiemgau Arena. In this case, the customer and the municipality of Ruhpolding may withdraw from the contract for the purchase of tickets for the event in question. The customer will be refunded the price paid, any fees incurred excluded, upon presentation or forwarding of the original admission ticket(s) at his own expense. Clause 6.3 concerning vouchers shall apply accordingly.
Furthermore, the customer acknowledges that the municipality of Ruhpolding is entitled to set up certain admission time windows for certain ticket holders for important reasons, e.g. due to specified protective measures in the context of pandemic control and in order to avoid larger crowds. In this case, the respective admission ticket holder is obligated to comply with the corresponding requirements. In the event of intentional or negligent non-compliance, the ticket holder may be denied access to the event premises outside the specified time window without compensation.
Furthermore, the customer acknowledges that for good cause, e.g. due to specified protective measures in the context of pandemic control, in particular due to official and/or instructions or orders of the responsible association (e.g. protection and hygiene concepts), additional rules, regulations and requirements may become valid in connection with access to and stay on the event premises. These will then be made available to the customer in good time and must be observed by the customer from the time they are announced. For example, it may be necessary that the customer, e.g. for the purpose of tracking chains of infection within the framework of specified protective measures of pandemic control, is requested to provide further data on his person and / or his companions (see on the permissible disclosure section 5.2) to the municipality of Ruhpolding in accordance with the applicable data protection regulations. If the customer does not agree with these further regulations, he/she may withdraw from the contract for the purchase of tickets for the event in question. The customer will then be refunded the price paid, any fees incurred excluded, on presentation or sending of the original ticket(s) at his own expense. Item 6.3 regarding vouchers shall apply accordingly.
3. ticket prices, discounts, terms of payment, ticket categories
3.1 Prices: The respective ticket prices ("Prices") stated on the order page in the ticket store https://biathlon-ruhpolding.reservix.de or on the official website of the OC Ruhpolding www.biathlon-ruhpolding.de (collectively: "Price Lists") shall apply.
3.2 Tax and Fees: The prices include the statutory German value-added tax. Depending on the ordering method and shipping method, the following service fees and/or shipping charges apply:
a) Order via Tourist Info Ruhpolding: a one-time service and shipping fee of 5.00 EUR is charged per order. These are waived when purchasing on site at Bahnhofstr. 8, 83324 Ruhpolding when paying directly and taking the purchased tickets with you.
b) Online order via www.biathlon-ruhpolding.de with redirection to the official ticket store https://biathlon-ruhpolding.reservix.de, order via www.reservix.de, order via www.adticket.de:
- Service fee per order: 2,00 EUR
- Shipping method [email protected]: + 0,00 EUR
- Shipping method by postal service: + 2,50 EUR
3.3 Cancellations: If payment is not successfully made for reasons for which the customer is responsible (e.g. insufficient credit card or account coverage, chargeback), the municipality of Ruhpolding is entitled to cancel the order without replacement or to electronically block the corresponding tickets; these will lose their validity. Any additional costs incurred are to be reimbursed by the customer. The municipality of Ruhpolding reserves the right to assert further claims for damages.
3.4 Discounts: Young people between the ages of eleven (11) and seventeen (17), schoolchildren, students, and severely disabled persons receive reductions on the prices according to the price lists. The respective proof of the reduction must be presented upon entering the Chiemgau Arena event area during the admission control. Double reductions will not be granted. For the passing on of reduced admission tickets, the regulations in section 5 apply with the additional proviso that passing on is only possible if the new holder also fulfills the corresponding reduction requirements, unless the new holder pays a surcharge in the amount of the difference between the reduced and a corresponding admission ticket at the box office before entering the Chiemgau Arena. An appropriate processing fee may be charged by the municipality of Ruhpolding for upgrading an admission ticket.
3.5 Children's tickets: Children up to the age of ten (10) also require an admission ticket. These are available free of charge, but only at the box office on the day of the event (the appropriate proof must be presented at the box office). Passing on children's tickets is excluded.
3.6 Categories: The customer acknowledges that the municipality of Ruhpolding is entitled, for good cause, e.g. due to specified protective measures in the context of pandemic control and specifications for compliance with distance areas, to assign the ticket holder seats of the same or a higher category deviating from his ordered seats.
4. No right of revocation and return
With its service of selling tickets for events, the municipality of Ruhpolding offers services from the area of leisure events/leisure activities at a certain date/period. This means that according to § 312 g Abs. 2 Nr. 9 BGB there is no right of revocation and/or right of return regarding the, e.g. online purchased, tickets. This means that a two-week right of revocation and return does not exist. Each submission of an offer or order for admission tickets is thus binding immediately after confirmation by the municipality of Ruhpolding or the corresponding authorized body and obligates the customer to accept and pay for the ordered admission tickets.
5. Use and passing on of admission tickets
In order to prevent the unauthorized passing on of admission tickets, in particular to avoid ticket speculation, and to maintain the broadest possible supply of admission tickets to fans at socially acceptable prices, it is in the interest of the municipality of Ruhpolding and the spectators to restrict the passing on of admission tickets.
5.1 Use and unauthorized transfer: The purchaser therefore agrees to purchase and use the ticket(s) exclusively for private purposes. Any commercial or business use / resale of purchased tickets without prior written consent of the municipality of Ruhpolding is prohibited. In particular, the purchaser is prohibited from
a) to offer and/or sell admission tickets publicly, at auctions or on the Internet (e.g. on eBay, eBay Kleinanzeigen, Facebook) and/or on sales platforms not authorized by the municipality of Ruhpolding (e.g. viagogo, seatwave, StubHub, etc.);
b) to pass on tickets at a higher price than the price paid. A price surcharge of up to 10% to compensate for transaction costs incurred is permissible;
c) to pass on admission tickets on a regular basis and/or in a larger number;
d) to sell or pass on admission tickets to commercial resellers and/or ticket dealers or ticket platforms;
e) to use or allow to be used admission tickets commercially or commercially without the express prior consent of the municipality of Ruhpolding, in particular for the purposes of advertising, marketing, as a bonus, as a promotional gift, as a prize or as part of an unauthorized hospitality or travel package; and/or
f) in the case of a (for example, by the responsible authority) ordered and data protection law permissible collection of the contact details of each customer and / or ticket holder (for example, for the purpose of tracking in the context of measures to combat pandemics) to sell or pass on tickets, without the municipality of Ruhpolding under naming the necessary contact details of the new owner is informed in a timely manner about the transfer of the ticket; the transfer of the data of the new owner is made in this case to protect the legitimate interests of the municipality of Ruhpolding in accordance with Art. 6 para 1 sentence 1 f) DSGVO.
5.2 Permissible transfer: A private, non-public transfer of an admission ticket for non-commercial reasons, in particular in individual cases of illness or other prevention of the customer, is permissible if there is no case of impermissible passing on in the sense of the regulation in section 5.1 and the customer (1) expressly informs the new holder of the validity and content of these ATGB as well as the necessary passing on of information (e.g., on request, first name and surname) about the new holder to the municipality of Ruhpolding in accordance with this section, (2) the new holder agrees by the purchase and use of the admission ticket with the validity of these ATGB between the municipality of Ruhpolding and the new holder. Ans the new owner agrees to the validity of these ATGB between him and the municipality of Ruhpolding by the purchase and use of the ticket and (3) the municipality of Ruhpolding is informed in time about the transfer of the ticket by naming the new owner or the municipality of Ruhpolding has implicitly declared the transfer to the new owner as permissible. On the one hand, the passing on of the new holder's data takes place for the fulfillment of the contracts between him and the municipality of Ruhpolding as well as between him and the customer according to Art. 6 para. 1 p. 1 b) of the DSGVO. On the other hand, this data processing is carried out to protect the legitimate interests of the municipality of Ruhpolding (according to Art. 6 para. 1 p. 1 f) DSGVO.
5.3 Unauthorized obscuring of information on admission tickets: It is prohibited to obscure the price or other elements of the admission ticket (such as warnings against unauthorized resale, dash or QR codes) on the admission ticket. In the event of a violation of this provision, the municipality of Ruhpolding is entitled to deny the holder of the affected admission ticket access to the Chiemgau Arena without compensation and to block the affected admission ticket.
5.4 Contractual penalty: In the event of a culpable violation by the purchaser of these ATGB, in particular of the obligations under section 5.1 and/or 5.3, the municipality of Ruhpolding is entitled, in addition to the other measures and sanctions possible under these ATGB and without prejudice to any further claims for damages, to impose an appropriate contractual penalty of up to EUR 2,500.00 on the purchaser. The exact amount of the contractual penalty shall be determined by the municipality of Ruhpolding on a case-by-case basis at its reasonable discretion and, in the event of a dispute, shall be subject to judicial review as to its appropriateness. The type and degree of fault (intent or negligence), successes of the purchaser with regard to compensation will be taken into account.
5.5 Exclusion from the purchase of admission tickets: The municipality of Ruhpolding reserves the right to exclude purchasers who violate the obligations under section 5.1 and/or 5.3 from the purchase of admission tickets in the future.
6. Event dates, postponement of events, cancellation
6.1 Initial situation: The events held in the Chiemgau Arena are outdoor events, so that the execution and times of the individual competitions can be influenced by the weather. In addition, the municipality of Ruhpolding is bound by the specifications and rules of the national and international sports federations when holding the events and the individual competitions. The days and times indicated e.g. on www.biathlon-ruhpolding.de or the order page https://biathlon-ruhpolding.reservix.de/events for the individual competitions held during an event are therefore non-binding.
6.2 Postponement, cancellation, abandonment: The municipality of Ruhpolding reserves the right to postpone the events as well as to change the program, especially to exchange individual competitions within the competition days. In these cases, the customer has neither a right to a refund nor a right of withdrawal. If the start time for a competition is postponed to another time of the respective competition day, the ticket entitles the customer to participate in this competition as a spectator.
In the event of cancellation up to the day before the date of the event, the price - in the case of multi-day tickets on a pro rata basis - will be refunded at face value less any fees incurred, upon presentation of the original admission ticket and provision of bank details. Item 6.3 regarding vouchers applies accordingly. In the event of cancellation or abandonment of the event on the day of the event due to force majeure, in particular adverse weather conditions (e.g. temperatures below minus twenty degrees Celsius (-20°C), fog, heavy snowfall), and in the event of impaired visibility, there shall be no entitlement to a full or pro rata refund of the price.
If an event is cancelled, the client has no right to a refund of the price paid, unless the municipality of Ruhpolding or the organizer is responsible for the cancellation or a weighing of the conflicting interests of the client with the interests of the municipality of Ruhpolding or the organizer speak in favor of a refund in the individual case.
6.3 Spectator exclusion: In the case of an event that must take place in its entirety (or in part, if the customer's ticket is affected by the partial exclusion) with the exclusion of spectators according to the stipulations of a responsible association or authority, both the municipality of Ruhpolding and the affected customer are entitled to withdraw from the contract for the purchase of tickets for the affected event. The withdrawal by the affected customer must be declared in text form (email is sufficient), by fax or in writing by mail. The affected customers shall receive a refund of the price paid, less any fees incurred, or a voucher to the value of the corresponding price for redemption as part of a future ticket purchase upon presentation or forwarding of the original ticket(s) at their own expense.
6.4 Duty to provide information: The customer or ticket holder is obliged to inform himself in good time about the current event schedule and the exact start of the competition in advance of the respective event/competition day for which the ticket conveys a right of admission. The latest information on this can be found at www.biathlon-ruhpolding.de.
7. Parking and transport to the Chiemgau Arena
7.1 Parking facilities and shuttle: In the local area of Ruhpolding, parking facilities will be provided by the municipality of Ruhpolding within the framework of the available (personnel, space and technical) capacities during major sporting events (e.g. World Cup, World Championships) and a free bus shuttle service will be set up from the individual parking spaces to the Chiemgau Arena.
7.2 No claim to parking spaces: The granting of parking facilities does not, however, establish any entitlement of the customer to a parking space and does not imply any obligation on the part of the municipality of Ruhpolding to monitor the parking area and the vehicles parked there. The liability of the municipality of Ruhpolding for damages caused by unauthorized interference of third parties is excluded.
7.3 No entitlement to shuttle: The establishment of the free bus shuttle service to the Chiemgau Arena does not establish any entitlement of the customer to transportation at certain times and also for persons who do not have a valid admission ticket. The arrival should therefore take place in any case early, because - especially shortly before the start of the competition - delays can occur due to the rush. A liability of the municipality of Ruhpolding for a late arrival at the Chiemgau Arena is excluded.
8. Liability of the municipality of Ruhpolding
The municipality of Ruhpolding is liable to the customer according to the legal regulations for damages only as far as these are based on intent or gross negligence of the municipality of Ruhpolding, its representatives or vicarious agents, i.e. not in case of simple negligence. This limitation of liability does not apply in the case of culpable injury to life, body or health or culpable violation of essential contractual obligations (i.e. obligations whose fulfillment makes the proper fulfillment of the contract possible in the first place and on whose compliance the contractual partner may regularly rely).
9. Chiemgau Arena, Stadium Regulations
The stay at and in the Chiemgau Arena is at your own risk. Access to the Chiemgau Arena and conduct on the event site before, during and after the event is additionally subject to the stadium regulations posted there, which are an integral part of these ATGB and which can be viewed, saved or printed on the official website of the OC Ruhpolding www.biathlon-ruhpolding.de. Every ticket holder is especially obliged to behave in the Chiemgau Arena in such a way that the legal interests of the municipality of Ruhpolding, the athletes, the spectators and all other persons present at events are not impaired and/or endangered. In the event of one or more violations by ticket holders or customers against these and the rules of conduct stipulated in the stadium regulations, the municipality of Ruhpolding, the police and/or the security personnel are entitled to confiscate prohibited objects brought by ticket holders or customers without compensation, and/or to deny ticket holders or customers access to the Chiemgau Arena without compensation and/or to expel them from the Chiemgau Arena or the arena.
10. Data protection
The municipality of Ruhpolding processes personal data within the framework of the ATGB and the circumstances described therein exclusively in accordance with data protection regulations, in particular the EU General Data Protection Regulation (DSGVO). For this purpose, the municipality of Ruhpolding provides corresponding data protection information.
11. Choice of law/place of performance/place of jurisdiction
The mandatory legal provisions of the country in which the customer usually resides shall apply. In all other respects, German law shall apply. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. The sole place of performance for delivery, service and payment is Ruhpolding. The place of jurisdiction for all disputes arising from or in connection with these ATGB and/or their validity or legal transactions based on these ATGB is Traunstein, unless the customer is a consumer.
12. Final clause
Should individual clauses of these ATGB be invalid in whole or in part, this shall not affect the validity of the remaining clauses or the remaining parts of such clauses. The parties shall replace an invalid provision with a provision that comes as close as possible to the economic purpose of the invalid provision. The same shall apply to any loophole in these ATGB.
